When an American Risked His Life For Basic Rights In Australia

A few months following my unlawful conviction and imprisonment in Australia, I was desperate to get word of the injustice to the world. I secretly planned a lone political plea for help from atop the roof of Acacia Prison on Mach 28, 2012, where I painted a large blue message to Australia’s then Prime Minister regarding the abuse of an American citizen in her country. It was a dangerous stunt, and I believed there was a good chance I would not survive it, but I was determined to try.

To the roof with me I took a hand-painted American Flag, which I had secretly painted at night under the cover of my blanket. It was about 28” – enough for any news helicopter to see it and know for fact that and American was protesting injustice. I had left instructions in a letter in my cell for the US consul (Perth) to please secure this flag and mail to my daughter in America. It took 6 months, but the prison finally released it to the consul who mailed it to my daughter.

What I wrote to my children on the bottom white stripe in 2012 is as poignant and powerful today as it was all those long years ago when I created it. The words I wrote to my is below:


“Dear Children, Joshua, Sarah, Amanraya - This Flag, symbol of the United States of America, was hand painted my me, your father, in Acacia Prison, Western Australia, March 11, 2012.
It is a symbol of all the United States stands for, was founded upon, including Freedom of Speech, Liberty and Justice for All.

It is the symbol of we born of the American Spirit, that we will never bow our heads to injustice, nor tolerate injustice in the world where we can fight it.
Here, in Australia, far from home, I have experienced first hand the type of injustice, prejudice and cruelty our founding fathers fought to become Independent from over 200 years ago in 1776.
I am in this prison today due to those injustices and prejudice, silenced, and for crimes I did not commit. Australia breached the UN Convention on Human Rights, Fair Treatment and ignored Natural Justice. No one ever heard my version of events nor seen my evidence that would expose the wicked lie against me, proving my innocence.

This Flag I now carry during my stand against this Injustice, this ignorant cruelty and bias.
This Flag I now carry during my stand for you, my children.

Amanraya - while you were born in Australia you are the daughter of your American father and your Heart and Spirit is your Father's Heart and Spirit. You are not a subject of a distant crown. This Flag is as much your symbol as it is for your brother and sister in America; a symbol whose essence and beliefs were born into you from me. Live Life as such, proud, strong and with integrity. Never bow your head to injustice. Never hang your head when False Witness is made against you. Never forget Who You Are - My daughter!

Joshua and Sarah: Never take for granted this symbol, which was forged of hope and dreams and blood and determination for over two centuries; of those who made stands, fought and sacrificed to keep it flying above our homeland through peace and war, good times and bad. Treat it as you would treat yourselves, for you and this Flag are one and the same - AMERICA.

You are all my children, the continuation of all I am, all our ancestors were and are within you. The continuation of our never-ending story.

Constitutional Right of All US citizens

Would you accept a conviction of one of your citizens who was tried in a country that has no Bill of Rights?
Including: no right to a lawyer, no right of due process?

Would you accept a conviction from said such country where the accused had been forced to face trial without legal counsel or legal knowledge - and against his stated desire to do so?



My Name is John Victor Ramses, US citizen, who married an Australian woman and resided in Australia throughout the marriage.

On 1 July 2010 I was accused of sexual assault by my former wife shortly following a divorce in order to prevent me from seeking access rights to my ten year old daughter via Family Court (Australia).

On that accusation, I was arrested off the street, charged and jailed in Hakea Maximum Remand Prison.

I pleaded not guilty, and had significant evidence to prove the accusations had been fabricated, and for what motive.

Police didn't care because, in Australia, they are "assigned to the complainant" and helping me would be "a confict of interest" (Quote) .

I had spent the next full year awaiting trial -- alone now in Australia with no family or support.

Legal Aid funding for legal representation had been denied twice. Professional lawyers wanted between $35,000 and $50,000 to begin, which I did not have. I was a US citizen now utterly alone in Australia following divorce of my wife of 11 years.

As trial aproached, I became more and more anxious, indeed, terrified that I would be made to stand trial alone without counsel or legal aknowledge. I wrote and phoned my US consulate several times and once wrote to the US Ambassador to intervene on my behalf to request Australia to grant me legal counsel for trial. They could not get involved.

As a result, I was made to stand trial in Western Australia for five terrible days without any legal knowledge on any aspect of trial proceedings, rules, and law of evidence. It was unbelievable to me that I would have been subjected to such abuse.

Australia has no Bill of Rights. There is no guarantee of due process or right to counsel for indigent persons. Australia, I would learn, has a nasty history of putting people to trial without legal representation (Carmen Lawrence, 2006). There is no right to evidence or witnesses.

During trial I was prevented from cross-examining the complainant. Thus, no challenge to her testimony / evidence before the jury was ever made by me. I was prevented from putting in certain relavant evidence while other vital evidence had been deliberately withheld by the prosecution.

I at last suffered and mental and emotional break down and was unable to function through the remaining two days of the FIVE-DAY trial.

Although I had pleaded with the judge routinely regarding my ineptness, and although the judge knew I was wholly incapable of defending myself in a foreign court and trial, said judge still allowed the trial to conclude in a "conviction".

I was sentenced to 6 and a half years in an Australian prison - the number of years until my daughter turned 18 (when the State would no longer concern themselve with her).

On 31 December 2017 I was deported from Australia back to my home country, The United States of America, landing in my home-town of Salt Lake City on New Year's Day 2018.

I had learned that I was now required to register for the US Sex Offender's Registry. Australia had stipulated that I remain on the registry 15 years (although the US requires only 10 years).

Now 9 years since that terrible arrest and trial, I and my family here in my home country are experiencing severe hardship and suffering - due solely to the sinister, unlawful treatment I had endured in Western Australia.

We are hoping for media attention on this matter and the question of wheher foreign convictions can be accepted by the US government where due process had not been afforded.

We are also seeking legal help by an appeal lawyer in Australia to appeal the Australian conviction, whereby putting an end to the suffering I and my family in America are currently enduring without resolve.

Alternatively, we are hoping to find a US lawyer who will put this case to a US court on the matter of whether such an inadequate trial as occurred in Australia should be acceptable according to US standards and our Constitution.

In my view, being punished in the United States on the basis of a coviction in a foreign country with inferior legal system and protocols in in direct violation of both my constitutional rights as well as public expectancy.


My Constitutional Right:

The 14th Amendment to the Constitution of the United States of America forbids any loss of liberty, or punishment, to any citizen of the United States, without first applying reasonable due process to determine guilt in an alleged crime.

Therefore, before any US citizen can be placed on any Registry in the United States, as a result of a 'conviction in a foreign country, (in particular, Australia) it must first be determined by a US court of law whether said foreign proceedings, investigation and trial was, by US law, fair and just. Clearly, mine was far from it. To ensure such protocols for the future is my goal.

In my case, there is signifacnt evidence to the contrary, as well as evidence demonstrating that members of my Australian wife's wealthy, infuential family 'pulled strings' to ensure that I would not be acquitted.

Under no circumstance of the Law and Constitution in the United States would the 'trial' I was subjected to in Australia be considered reasonal or capable of sustaining a conviction.

I am seeking legal representation here in the United Stated to put my case before a US court to determine the adequacy of the Australian proceedings and trial where I hope a ruling will decalre the Australian trial unfair and inadequate.

Such a rulng by a US court would be cause to remove me from the strict Registry requirements where I can then pursue an appeal to the High Court of Australia to overturn the conviction.

5th Ammendendment to the U.S. Constitution -

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation

The 6th Amendment to the U.S Constitution -

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

14th Amendment to the U.S. Constitution - Section 1.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
